Terms of use and sale

Last updated: October 10, 2026

This translation is provided for information. In case of discrepancy, the French version prevails.

1. Purpose

These terms govern the use of the Winterarc mobile application (the “Application”), published by Victor Gassmann, an independent developer based in France (the “Publisher”), and the purchase of the subscriptions that give access to it. Downloading and using the Application constitutes acceptance of these terms. The Application is available in French, English, Spanish, Italian and German; these terms are written in French, and where they are translated, the French version prevails.

2. Description of the service

Winterarc is a 90-day personal discipline challenge (a “winter arc”) based, by default, on nine rules: seven to be completed every day and two to be kept over the week (Gym and Run). The Application provides daily and weekly tracking of these rules, synchronization of these check-ins across devices, reminders through local notifications, reading of the step count through Apple Health if the user allows it, and a winter arc start photo and end photo stored only on the device.

Winterarc is not a medical device and does not provide any personalized medical, nutritional or fitness advice. The suggested rules are general goals; each user adapts their practice to their own situation and consults a health professional if in doubt.

3. Access and account

The Application is restricted to people aged 16 or over. It can be used free of charge in its entirety (the nine rules, the flame, tracking, photos, reminders) after signing in with “Sign in with Apple” or “Continue with Google”. No password is created or stored by the Publisher.

4. Duo, groups and leaderboards: usernames and conduct

Duo lets two players do their winter arc together and keep a shared flame: each keeps their own winter arc and rules, and the flame grows every day on which both have a full day. Each player chooses a public username (@username).

Groups bring together 3 to 30 players, depending on the number of spots chosen by their creator, and are joined through an invite link or code. Each player keeps their own winter arc and rules; the group's flame grows every day on which at least half of the members have a full day, and a weekly leaderboard compares full days. A member who does not have a full day on two days of the same week (Monday to Sunday) automatically leaves the group, and can join it again after 7 days. When the group is full, newcomers sign up for a waiting list: the spot that opens up goes to whoever has had the most full days since signing up. The group's owner (its creator, or the longest-standing member if the creator leaves) can remove a member, who can then no longer come back, and change the invite link. A player belongs to only one group at a time, in addition to any duo. Public groups are opened by creators whom the Publisher activates personally: they have up to 100 spots and can also be opened through the creator's winter-arc.fr/@username link; the other group rules apply to them.

The streak leaderboard is optional: a player who signs up for it appears on it with their username and their current streak of full days in a row, visible to all players, and can leave it at any time. Streaks are calculated from the days sent by the Application; the Publisher may remove from the leaderboard a player whose days appear to be falsified.

Usernames and group names must not contain anything abusive, hateful or sexual, and no harassment is tolerated, including through repeated invitations. Usernames and group names go through a word filter before they are saved. Anyone can report a username or a behavior and block a player from within the Application. Reports are handled within 24 hours: anything that breaks these rules is removed, and the account responsible may be deleted.

5. Pro subscription and prices

The “Pro” subscription gives access to rule customization (changing a weekly goal, removing or adding rules, from three to twelve), to ready-made rule programs and to Home Screen and Lock Screen widgets. It is offered as an auto-renewable subscription, purchased and billed exclusively by Apple through the App Store:

PlanDurationPrice incl. VAT (France)
Yearly1 year€29.99
Monthly1 month€14.99
Yearly, launch offer1 year€17.99 (offered only once, for 5 minutes, after the main offer is declined)

The prices displayed in the Application come from the App Store and are authoritative; they may vary by country. Payment is charged to the Apple Account upon confirmation of purchase.

Referrals: an account created less than 14 days ago can name a referrer, through the referrer's winter-arc.fr/@username link, their username entered in the Application, or the invitation (duo or group) that brought it in. An account has only one referrer. When the referred player has their first full day, the referrer receives a free month of Pro access, with no payment and no automatic renewal, up to a maximum of 12 months per referrer. This free month is neither refundable nor exchangeable; the Publisher may cancel it if it was obtained through fake accounts or falsified days.

6. Renewal and cancellation

The subscription renews automatically for the same duration, at the price then in effect, unless it is canceled at least 24 hours before the end of the current period. Cancellation is done in the Apple Account settings (Settings → Subscriptions); it takes effect at the end of the period, with no refund for the period already begun. Deleting the Application does not end the subscription. On expiry, the custom rules already saved remain in effect; only the ability to change them again requires an active subscription.

7. Right of withdrawal and refunds

In accordance with Article L221-28 of the French Consumer Code (Code de la consommation), the right of withdrawal does not apply to digital content whose performance has begun with the consumer's agreement. Refund requests are handled by Apple under its own terms, at reportaproblem.apple.com.

8. Personal data

The processing of data is described in the privacy policy, which forms part of these terms.

9. Intellectual property

The Application, its brand, texts, design and code are the property of the Publisher. The subscription grants a personal, non-exclusive and non-transferable right of use. Visuals that the user chooses to share from the Application (progress, quotes, a photo from their library added to a story, reveal photos) are shared under the user's sole responsibility.

10. Availability and liability

The Publisher strives to provide continuous access to the Application but does not guarantee that it will be free of interruptions, in particular for maintenance or in the event of a failure of third-party services (Apple, hosting provider). The Application works offline and resynchronizes data when the network is back. The Publisher cannot be held liable for the consequences of the user's physical activity or dietary choices, nor for any loss of data resulting from the user deleting the Application (photos, stored only on the device, are then lost).

11. Changes to these terms

The Publisher may change these terms; the version in force is the one published at winter-arc.fr/cgu. Any substantial change is announced in the Application.

12. Governing law

These terms are governed by French law. In the event of a dispute, a user acting as a consumer may turn, free of charge, to a consumer mediator. Failing an amicable settlement, the French courts have jurisdiction.
